Some notes on the Terms and Conditions

Rates

1. Rates include Unlimited mileage and a choice of standard or super waivers, additionally VAT, airport surcharges and tourism levies are also included in the rate. A once off R43 contract fee per rental is charged additionally to the published rates.
2. Rates are not commissionable, and due to the discounted nature of our online rates, redemption of voyager miles is not applicable.
3. Conditions are subject to change without prior notice and all vehicles are rented subject to the detailed terms and conditions in the Rental Agreement.

Please Bring With You

When you arrive at our counters, please bring your reservation and/or booking confirmation, driver's license, your embossed credit card and/or your ID/Passport.

Drivers

1. Upon collection of the vehicle, a valid, unendorsed licence must be produced by the hirer or authorised driver, in addition to their reservation confirmation and their ID Book or Passport.
2. Minimum age for hirers or authorised drivers is 23 years of age and the drivers licence must have been valid for a minimum of two years.

Additional Drivers

1. Additional drivers may only be nominated and authorised by the Renter. The additional driver must be in possession of a valid, unendorsed licence.
2. Rentals may not be extended by additional drivers.
3. No additional drivers may be added during the rental unless the vehicle is inspected beforehand at a Tempest rental location.
4. During weekend rentals the official Renter should accompany additional drivers while using the rental vehicle.
5. The Renter is liable for all risks/charges applicable to usage of vehicle by the nominated additional driver.

Vehicles

1. All speedometers are sealed and any forced interference with the speedometers will result in the rate immediately reverting to daily rates and 500 kms per day will be charged.
2. In the event of a break-down (due to client error or negligence) or accident, the hirer will be responsible for all resultant costs, including towing. Towing due to mechanical failure on the vehicle (where the renter is not responsible for the failure) will be covered by Tempest Car Hire.
3. All accidents (should the damage be more than R1000) and vehicle thefts are subject to a R400 administration charge per incident. This is over and above the reduced liability amount payable.
4. Personal belongings stolen from vehicles are not covered.
5. The client has the right to appoint their own assessor providing this is done within 72 hours of the accident and Tempest is notified accordingly, failing which Tempest reserves the right to appoint their own Assessor. The rental will remain open until such time as Tempest receives the keys to the vehicle.

Cross Borders

Please note that Cross Borders into other countries are not allowed with our Tempest Car Hire packages. If you like to cross into other countries, please view our Europcar car hire packages here.

Breach of Contract

1. All related and unrelated costs shall be borne by the Renter in the case of Breach of Contract. Some examples of Breach of Contract are:-

* Accident occurring after vehicle is due back
* Driving under the influence of alcohol
* Accident due to traffic violation
* Unauthorised drivers
* Where negligence can be proven
* In the event of accident damage or theft caused to the vehicle whilst being driven by a driver not specified on the Rental Agreement, the hirer will be responsible for the full value of damage or loss.

If you plan to hire more than one car, more than one rental: Please note that the reduced liability authorisation hold / deposit on your credit card may usually take 4 - 14 working days to be released back onto your credit card after the end of the rental (for the funds to show as available again) - this timeframe depends on your Bank / Credit Card company. (The car hire company release / reverse the deposit hold / block immediately when you return the car, but there may be delays with your Bank to process the cancellation of the hold from your credit card) If you hire more than one car at different locations after each other, please ensure that you have enough funds available on your credit card for the second rental's deposit authorisation to be processed, while awaiting the first deposit authorisation to be released back onto your credit card by your Bank (funds to show as available again on your credit card) as each rental branch act independently from one other. Please also contact your Bank / Credit Card company immediately after the release of the first authorisation hold by the Car hire company (when returning the first car) to release / cancel the hold from your credit card immediately to avoid any delays. Please note that we cannot take responsibility if your Bank / Credit Card company delays the release of the authorisation hold onto your credit card, as this is totally out of our control. Alternatively please choose our super cover option for all your rentals where the deposit is much lower. Please contact Cape Spirit if you are unsure.

Booking a Car through Cape Spirit

The relationship between the renter and Cape Spirit™ Travel is for reserving the car at the requested destination and rental supplier. Cape Spirit's responsibility is limited to issuing the reservation voucher properly, in order to make a connection between the renter and the rental supplier at the competitive quoted rate. Should the renter not receive the booking voucher within 5 minutes after making the reservation, the renter has to contact Cape Spirit™ immediately. Cape Spirit™ will assist the renter with any booking enquiries during and after the reservation.

Upon collection of the car, the renter will sign a new contract with the rental supplier. Cape Spirit™ Travel will do its utmost to assist and provide a solution in case of any problem the renter encounters with the rental supplier.

Any claim against the rental supplier should be forwarded to the rental supplier directly. The jurisdiction location for claims against the rental supplier will be the country where the rental took place.

The rental supplier has the right to deny a car from anyone who does not comply with the above terms and conditions.
The renter should request a copy of the final rental agreement when returning the car, and keep it for future queries.
Accepting the voucher and applying it states your agreement to the above terms and conditions.
