Tempest Car Hire Terms and Conditions
Rates
1. Rates include Unlimited mileage and a choice of standard or super waivers, additionally VAT, airport surcharges and tourism levies are also included in the rate. A once off R38 contract fee per rental is charged additionally to the published rates.
2. Rates are not commissionable, and due to the discounted nature of our online rates, redemption of voyager miles is not applicable.
3. Conditions are subject to change without prior notice and all vehicles are rented subject to the detailed terms and conditions in the Rental Agreement.
Payment
1. Payment is by embossed credit card only (raised digits), we accept all major credit cards (Visa, Amex, Mastercard, Diners) but regrettably we cannot accept debit cards, cheque cards, cash, cheques or bank transfers.
2. The card holder must be the renter and the credit card is not transferable. In other words, the credit card holder and the primary driver must be the same person and needs to be present at the time of collecting the vehicle.
3. How payment works: Upon collection of the vehicle, your credit card will be charged with the rental amount, an additional day's rental and a tank of fuel. Any expenses for extras e.g. additional driver charge, will also be billed. Additionally, an authorisation hold will be placed on your card for the applicable excess amount; this hold will be released within 4 working days once the car has been returned, providing there is no accident or theft damage.
4. The Renter must be in possession of an embossed credit card and 2 valid forms of identification for the rental of Group E vehicles. A valid, unendorsed driver's license is a pre-requisite and a second form of identification such as an ID Book, Passport, Medical Aid card or ATM Card must be shown to validate the Renter's credentials.
5. We hold an authorisation amount on the excess amount on your card, this hold is released 4 days after you have brought back the vehicle, providing there is no accident or theft damage.

Waivers and Exceptions
Excesses
Rates are inclusive of collision damage waivers and theft waivers. In the event of an accident you are liable for the excess amounts as shown below:-
Please note that the excess amounts do not cover repairs to tyres, windscreens, and under-carriage, and the costs for these repairs will be for the Renter. Should these components be damaged as a result of an accident, they are covered by the excess.

Waiver Exceptions
An exceptions excess is payable in the following instances:-
* Where damage to a vehicle is caused by you and no other vehicle is involved, and the damage is less than R50,000, the Renter is liable for the excess amount. Should the damage exceed R50,000, the Renter is liable for the Exceptions excess amount.
* Where damage to a vehicle is caused by you whilst driving on roads not suitable for it, on weekend rentals and where the vehicle is uneconomical to repair, an exceptions excess is payable.
* An Exceptions excess is 2.5 times the waiver excess amount indicated in the table above.
* In the event of an accident with a third party, failure to obtain full and correct third party details will result in an exceptions excess being charged. You will find all required information on the back of the rental envelope.

Drivers
1. Upon collection of the vehicle, a valid, unendorsed licence must be produced by the hirer or authorised driver, in addition to their reservation confirmation and their ID Book or Passport.
2. Minimum age for hirers or authorised drivers is 23 years of age and the drivers licence must have been valid for a minimum of two years.
Additional Drivers
1. Additional drivers may only be nominated and authorised by the Renter. The additional driver must be in possession of a valid, unendorsed licence.
2. Rentals may not be extended by additional drivers.
3. No additional drivers may be added during the rental unless the vehicle is inspected beforehand at a Tempest rental location.
4. During weekend rentals the official Renter should accompany additional drivers while using the rental vehicle.
5. The Renter is liable for all risks/charges applicable to usage of vehicle by the nominated additional driver.
Conditions of Rental
1. There can be no extension of rentals without prior authorisation from Tempest Car Hire. An unauthorised extension negates collision and theft cover.
2. Rentals are charged per 24 hours. Late return of vehicles will result in being charged for a further day.
3. Rentals will be charged until such time as the vehicle keys are returned.
4. All fines and penalties incurred in the duration of the hire are strictly for the liability of the driver. This includes valets for cars that are returned in conditions not accepted as normal. A R175 traffic fine handling fee will be levied over and above the fine amount per incident.
5. On termination of the rental, vehicle keys must be returned to an authorised personnel member of Tempest Car Hire. Failure to do so will result in the hirer being fully liable for the value of loss or damage.
6. In the event of loss of keys, the hirer will be responsible for all resultant costs.
7. Supplying a replacement vehicle after an accident or theft is entirely at our discretion and we reserve our rights accordingly.
Vehicles
1. All speedometers are sealed and any forced interference with the speedometers will result in the rate immediately reverting to daily rates and 500 kms per day will be charged.
2. In the event of a break-down (due to client error or negligence) or accident, the hirer will be responsible for all resultant costs, including towing. Towing due to mechanical failure on the vehicle (where the renter is not responsible for the failure) will be covered by Tempest Car Hire.
3. All accidents (should the damage be more than R1000) and vehicle thefts are subject to a R400 administration charge per incident. This is over and above the excess amount payable.
4. Personal belongings stolen from vehicles are not covered.
5. The client has the right to appoint their own assessor providing this is done within 72 hours of the accident and Tempest is notified accordingly, failing which Tempest reserves the right to appoint their own Assessor. The rental will remain open until such time as Tempest receives the keys to the vehicle.
6. Undercarriage, Windscreen and Tyre Damage:-
The excess does not cover repairs to tyres, windscreens and under-carriage, and the costs for these repairs will be for the Renter. Should these components be damaged as a result of an accident, they are covered by the excess.
Personal Accident Insurance
1. Our rates exclude cover for personal accident insurance, this is available at an additional R25/day. Personal accidental insurance covers the passengers in the vehicle and cover is provided as below. The policy is underwritten by Regent Insurance in South Africa.
* Accidental death: R250,000 per incident
* Permanent disability: R250,000 per incident
* Emergency medical expenses: R20,000 per incident
* Guaranteed hospital admission: R5000 per incident
Extras
Delivery and collection
We can deliver or collect your vehicle. When making your booking, please select the branch closest to where you require your vehicle delivered/collected and furnish the address details when completing your booking. Delivery and collection charges are as follows:-
* < 25 kms : R220.00 during office hours; R440.00 after hours
* > 25 kms : R220.00 during office hours; R440.00 after hours + R4.40 per extra km
Additional Drivers
Charges will increase by R160 per rental for each additional driver nominated. In the event of accident damage or theft caused to the vehicle whilst being driven by a driver not specified on the Rental Agreement, the hirer will be responsible for the full value of damage or loss.
Baby seats
Baby seats are available at R50 per day and capped at R200 per rental. Our baby seats are suitable for toddlers up to 14 kg's. Please note that babyseats are subject to availability and during holiday season and at coastal locations.
After Hours Surcharges
Please refer to our branch listings for branch opening and closing hours. Any collection of a vehicle outside of these hours will be subject to an after hours surcharge of R110.
Cross Borders
Please note that Cross Borders into other countries are not allowed with our Tempest Car Hire packages. If you like to cross into other countries, please view our Europcar car hire packages here.
One Way Fees
One way fees are subject to a charge of R800 between regions. The list below provides a guide-line for the various one way fee exceptions:-

Breach of Contract
1. All related and unrelated costs shall be borne by the Renter in the case of Breach of Contract. Some examples of Breach of Contract are:-
* Accident occurring after vehicle is due back
* Driving under the influence of alcohol
* Accident due to traffic violation
* Unauthorised drivers
* Where negligence can be proven
If you plan to hire more than one car, more than one rental: Please note that the excess authorisation hold / deposit on your credit card may usually take 4 - 14 working days to be released back onto your credit card after the end of the rental (for the funds to show as available again) - this timeframe depends on your Bank / Credit Card company. (The car hire company release / reverse the deposit hold / block immediately when you return the car, but there may be delays with your Bank to process the cancellation of the hold from your credit card) If you hire more than one car at different locations after each other, please ensure that you have enough funds available on your credit card for the second rental's deposit authorisation to be processed, while awaiting the first deposit authorisation to be released back onto your credit card by your Bank (funds to show as available again on your credit card) as each rental branch act independently from one other. Please also contact your Bank / Credit Card company immediately after the release of the first authorisation hold by the Car hire company (when returning the first car) to release / cancel the hold from your credit card immediately to avoid any delays. Please note that we cannot take responsibility if your Bank / Credit Card company delays the release of the authorisation hold onto your credit card, as this is totally out of our control. Alternatively please choose our super cover option for all your rentals where the deposit is much lower. Please contact Cape Spirit if you are unsure.
Booking a Car through Cape Spirit™
The relationship between the renter and Cape Spirit™ Travel is for reserving the car at the requested destination and rental supplier. Cape Spirit's responsibility is limited to issuing the reservation voucher properly, in order to make a connection between the renter and the rental supplier at the competitive quoted rate. Should the renter not receive the booking voucher within 5 minutes after making the reservation, the renter has to contact Cape Spirit™ immediately. Cape Spirit™ will assist the renter with any booking enquiries during and after the reservation.
Upon collection of the car, the renter will sign a new contract with the rental supplier. Cape Spirit™ Travel will do its utmost to assist and provide a solution in case of any problem the renter encounters with the rental supplier.
Any claim against the rental supplier should be forwarded to the rental supplier directly. The jurisdiction location for claims against the rental supplier will be the country where the rental took place.
The rental supplier has the right to deny a car from anyone who does not comply with the above terms and conditions.
The renter should request a copy of the final rental agreement when returning the car, and keep it for future queries.
Accepting the voucher and applying it states your agreement to the above terms and conditions.
